Your use of this Site and your purchase or engagement with Creator Nourish’s 1:1 strategy coaching, keynotes, workshops, talent partnership programs, digital guides, and materials signify that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must cease use of the Site and refrain from engaging our services.
1. General Acceptance & Agreement
These Terms constitute the complete agreement between you and Creator Nourish ("we," "us," or "our") concerning your access to the Site and the acquisition or delivery of our Services.
- 1.1 Governing Law and Jurisdiction: These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any dispute arising out of or in connection with the Site or Services shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
- 1.2 Changes to Terms: Creator Nourish reserves the right to review and change these Terms at any time by updating this page. Any changes take immediate effect from the date of their publication. Your continued use of the Site and Services after such changes constitutes acceptance of the modified Terms.
2. Intellectual Property & Commercial Ownership
- 2.1 Site Content: All content on the Site, including text, editorial copy, branding assets, graphics, logos, images, audio reflections, and layout structure, is owned by Creator Nourish and protected by Australian and international copyright laws.
- 2.2 Proprietary Frameworks & Coaching Materials: All proprietary frameworks, strategy tools, operational systems, templates, guides, audio content, workshop materials, and written resources produced or delivered by Creator Nourish, whether delivered digitally, in-person, or via 1:1 strategy coaching, are the exclusive intellectual property of Creator Nourish. You are granted a limited, non-exclusive, non-transferable license to use these materials solely for your personal creator business development or internal operational use.
- 2.3 Strict Usage Restrictions: You are strictly prohibited from copying, adapting, reproducing, redistributing, reselling, teaching, or publishing any Creator Nourish materials, frameworks, or proprietary coaching methodologies, in whole or in part, for commercial reproduction, public distribution, or inclusion in your own commercial service offerings without our prior written consent.
3. Terms Governing Services & Partnership Containers
- 3.1 Access, Booking & Payments: Access to scheduling, digital resources, and strategy sessions is facilitated securely via third-party providers integrated into the Site (Cal.com, Kit, and Zoom). All fees are processed securely through third-party payment gateways (Stripe) or custom corporate invoices. By completing a booking or invoice payment, you agree to their respective terms.
- 3.2 Private 1:1 Strategy Coaching (Individual Creators)
- Rescheduling & Cancellations: Single strategy sessions or ongoing coaching appointments require a minimum of 48 hours’ advance notice to reschedule. Sessions missed or canceled with less than 48 hours’ notice are forfeited without refund.
- Retainers & Multi-Month Containers: Entry into 1:1 strategy coaching containers is by mutual alignment. Payments are made upfront or via agreed billing schedules. Because container capacity is strictly limited, retainer fees are non-refundable once paid. Ongoing extensions may be canceled with a minimum of 7 days' written notice prior to the next billing date.
- Punctuality: Late arrivals will still finish at the scheduled end time to respect subsequent bookings. Lost time will not be extended or refunded.
- Confidentiality: To maintain a safe and grounded strategic space, all 1:1 coaching discussions remain strictly confidential between the client and Creator Nourish.
- 3.3 Keynotes & Interactive Workshops (Events & Retreats):
- Booking Confirmation: Live keynotes and group workshops (virtual or in-person) are confirmed upon execution of an event agreement and payment of the agreed deposit or full presentation fee.
- Event Transfers & Rescheduling: If an event host needs to reschedule a live session, a minimum of 14 days' written notice is required to transfer fees to a future date, subject to schedule availability.
- Participant Attendance: For public or closed group workshops, individual attendee tickets are non-refundable but may be transferred to another person with at least 24 hours' notice prior to the start time.
- 3.4 Talent Partnerships (Agencies & Creator Managers):
- Scope of Work: Creator Nourish acts as an external execution strategy and performance partner, providing internal operational strategy coaching to agency-represented creators and talent cohorts.
- Separation of Agency Deal Flow: Creator Nourish does not negotiate commercial brand deals, manage talent contracts, or act as talent representation. Agency management retains full authority over deal negotiations and commercial representation.
- Talent Privacy: While agency leadership receives high-level status updates regarding general participation and capacity alignment, specific personal coaching disclosures made by individual creators during 1:1 sessions remain 100% confidential.
4. General Legal Provisions & Disclaimers
- 4.1 Professional Strategy & Somatic Disclaimer: Services provided by Creator Nourish are for executive business strategy, performance optimization, content operational planning, and somatic regulation education. Creator Nourish is not a licensed medical clinic, psychological practice, psychiatric facility, financial brokerage, or legal advisor. Our strategy coaching and somatic tools do not substitute for clinical mental health treatment or medical advice. Clients and agency partners remain fully responsible for their own business, mental, physical, and financial decisions and outcomes.
- 4.2 Limitation of Liability: To the maximum extent permitted by law, Creator Nourish will not be liable for any indirect, incidental, consequential, or economic loss arising from your use of the Site or Services. Total aggregate liability will not exceed the resupply of the Service or the amount paid by you for the specific session, workshop, or engagement.
- 4.3 Indemnity: You agree to indemnify and hold harmless Creator Nourish from and against all claims, liabilities, damages, and expenses arising out of your breach of these Terms or your misuse of the Site and Services.
- 4.4 Competitor Restriction: If you operate a commercial practice offering similar strategy coaching, performance optimization for creators, or agency talent retention coaching, you are considered a Competitor. Competitors are prohibited from accessing or downloading our proprietary frameworks, guides, or workshop materials for commercial reproduction.
- 4.5 Severability: If any provision of these Terms is deemed invalid or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
